Background: Patients’ rights are universal values that must be respected; however, it is not easy to put such values and principles into effect as approaches and attitudes differ from individual to individual, from society to society, and from country to country. If we want to reach a general conclusion about the status of patient rights in the world as whole, we should examine the situation in individual countries. Objective: To study the effect of training sessions for nurses about patients’ rights (...) on the perceptions of nurses and patients in two Egyptian hospitals. Methods: Quasi-experimental with pre- and posttest design was used in this study. Two groups of participants were included in the study: the first with 97 nurses and the second with 135 patients. A questionnaire sheet was used for nurses and patients to assess their perceptions about patients’ rights before starting sessions. The training sessions were developed based on the baseline information gathered in the assessment phase and related literature. After the implementation of the sessions, a posttest was immediately conducted for nurses, while for patients the posttest was conducted 1 month after implementation to evaluate the effect of the nurses’ training sessions on the patients’ perceptions. The same tools were used in pretest and posttest. Ethical considerations: Written approval was sought and obtained from the administrators of the studied hospitals prior to conducting the study. Oral consent was obtained from nurses and patients willing to participate. Confidentiality and anonymity of the participants were strictly maintained through code numbers on the questionnaires. Results: The improvement in nurses’ knowledge and perceptions about patients’ rights after implementation of the training sessions was remarkable. Moreover, an improvement in patients’ perceptions regarding their rights was reported. Conclusion: Repetition of the training sessions is suggested to achieve continuous improvement. Provision of posters and booklets about a bill of patient rights within the hospitals and conduction of further study to examine nurses’ performance and patients’ satisfaction based on code of ethics are recommended. Despite head and neck cancer association with various negative impacts, collective evidence is accumulating regarding the positive impacts of positive psychology on cancer survivors. However, data on how positive psychology is related to the psychological complications of HNC across time are lacking. This longitudinal study examined the trends of positive psychology, perceived spousal support, and psychological complications and determined the association between them, psychological complications, and PTG across two timelines among a cohort of HNC patients. A total of 175 HNC (...) respondents exhibited an increasing trend of positive psychology and perceived spousal support while reporting a decreasing trend of psychological complications between baseline and follow-up assessments. A greater degree of hope and perceived spousal support contributed to a higher degree of PTG across time. Conversely, a higher severity of anxiety symptoms was associated with a lower degree of PTG over time. Female gender had a moderating effect on the association between severity of anxiety symptoms and PTG, but did not moderate the association between hope, perceived spousal support and PTG. This study indicates the pivotal role of incorporating psychosocial interventions into the treatment regimen to enhance the degree of hope and perceived spousal support and reduce the severity of anxiety symptoms, which, in turn, will facilitate the development of PTG in HNC patients. The third century of the hegira represents an extremely important period in terms of the formation process of Islamic sciences and the acquirement of the identity of a systematic school of fiqh madhhabs. In terms of the Zaydiyya madhhab, this century has an identity that affects the next period in terms of both political and scientific studies. Because in this period, the scholars of the madhhab like Kāsim al-Rassî (d. 246/860), Ahmad b. Isā (d. 247/861) and Yahyā b. al-Husayn (d. (...) 298/911), who were in a leading position both in politics and in sciences such as kalām, hadith and fiqh, emerged. Kāsim al-Rassî, who was accepted as the star of the Ahl al-Bayt by Zaydî sources in the first period, was presented as the Plato of Muslims by orientalists in modern studies. The main reason why today's studies on him are mostly about the history of sects and theology, most of Rassî's works are about kalām. However, Kāsim al-Rassî is an important name in the science of fiqh and İslamic legal theory as well as in the science of kalām. According to Abī Tālib Nātik bi’l-Hakk (d. 424/1033), one of the important jurists of the Zaydiyya madhhab, Rassî was a scholar who came to the fore with his ability in fiqh issues; in order to see his ijtihād method, his skill in furû al-fiqh, his mastery in using hadiths and knowing the disagreements of scholars, ‘‘Masā’il al-Dja’far b. Muhammad and Abd Allah b. Hasan” should be consulted. Rassi's epistles named Kitab al-Nāsikh wa’l-Mansūkh, Kitab al-tahāra, Kitab al-salāt al-yevm ve al-Laylā and Kitab al-menāsik are important studies on fiqh that have survived to the present day. In addition, Mueyyed-Billah (d. 411/1021) compiled Kāsim al-Rassî’s and Yahya b. al-Husayn's views on fiqh in his work named al-Tecrîd. Kāsim al-Rassî's views on fiqh are also determinative in later fiqh books such as Tahrîr, al-Cāmi' al-Kāfi, al-Intisār and al-Azhar. In time, the emergence of a jurisprudence sect named Kāsimiyya in Zaydiyya, referring to his name, is also important in terms of revealing his position. Although Rassî's views on fiqh have been referred to a number of studies in our country, no independent study has been found that deals with his views on fiqh. However, considering both of his works on fiqh that have survived to the present day and the early works in which his views are compiled, it is obvious that Kāsim al-Rassî's views on fiqh deserve an independent works. The aim of this study is to reveal Ressî's position within the madhhabs and his perspective on fiqh in general. In this context, in the study, the period in which Ressî lived, his life and works were briefly mentioned, and then the basic views of the fiqh, especially in the field of worship, were discussed in outline. In this study, the classification of Zaydī fuqahā’ that emerged in the mutaaḫḫirūn period of Zaydī fiqh and related terms are examined. The book named Bulūgh al-arab wa-kunūz al-dhahab fī-maʿrifat al-madhhab, which has great importance among the studies aiming to present the Zaydī fiqh accumulation as a uniform doctrinal structure was taken as a basis in the processing of the subject. After an introduction in which Zaydī fiqh studies are evaluated in their relationship with the subject, the issue is handled (...) under three main headings. In the first title, the author and his work are introduced, and in the second and third titles, the methods and terms used in the classification of the Zaydī fukahâ are examined. The author of the work is ʿAlī b. ʿAbd Allāh al-Shaharī (d. 1190/1776) who lived during the period of the Qāsimī dynasty (al-dawla al-Qāsimiyya) in Yemen. The most important feature of the work, which was prepared using many sources that were attributed importance among the Zaydī literature, is that it was the most comprehensive of all that had written on madhhab doctrine until then. The first part of the work explains that the right madhhab to be followed is Zaydiyya. In the second part, the classes of the Zaydī fuqahā’, which is the subject of our study, are explained. The fuqahā’ classes are primarily divided into two parts: al-salaf al-ṣāliḥīn and al-ḫalaf al-ṣāliḥīn. The first dates back to the beginning of the 3rd/10th century. This class is divided into two parts, as al-sābiqūn and al-mutaaḫḫirūn. The sābiqūn starts with ʿAlī b. Abī Ṭālib, his two sons al-Ḥasan and Ḥusayn and ends with the sons of twelve imams who are their descendants. Zayd b. ʿAlī (d. 122/740) is one of the twelve imams. The most important of the faqīhs in the part of mutaaḫḫirūn, which started with al-Qāsim b. Ibrāhīm al-Rassī (d. 246/860), are the six imams called ahl-al-nuṣūṣ or aʾimma al-nuṣūṣ. The reason why they are named as such is that their words were taken as a basis in determining the views of the sect on the field of uṣūl and furūʿ l-fiqh. al-Qāsim al-Rassī is at a point where all the knowledge of the Prophet's family and the principles agreed upon by sābiqūn, reach him through many channels. al-Hādī Yaḥyā b. al-Ḥusayn (d. 298/911), grandson of al-Qāsim, is the most important imam in terms of his position in the madhhab. The ḫalaf al-ṣāliḥīn is also divided into two parts as ahl l-taḥṣīl and ahl l-naẓar. The first part also referred to as muḥaṣṣilūn or aʾimma al-taḥṣīl, has no subcategories. The second part is divided into two sub-sections as ahl l-taqrīr and mudhākirūn. The muḥaṣṣilūn class starts with those who catch up with the last class of ahl al-nuṣūṣ and ends with ʿAbd Allāh b. Ḥamza (d. 614/1217), one of the three important imams. Two other important imams of muḥaṣṣilūn are Aḥmad b. al-Huṣayn (d. 411/1020) and his brother Yahyā b. al-Husayn (d. 424/1032). It is the fiqh activity of the jurists of this class, called taḥṣīl l-madhhab, that brought Zaydī fiqh, which was fiqh of imams (madhāhib l-aʾimma) in its first period, into a single madhhab and to its classical form in the last period. Mudhākirūn jurists lived at the same time as the ahl-t-taqrīr. This period is about 700 years from the beginning of the 6th/12th century, which is the last century of the muḥaṣṣilūn class, to the end of the 12th/18th century, when Shaharī lived. The roles of the ahl al-taqrīr in the madhhab mostly consist of reviewing the works of the ahl-l tahṣīl, approving the correct ones, and correcting the wrong ones. That's why they are so named. The author of Kitāb l-Azhār, Aḥmad b. Yaḥyā l-Murtaḍā (d. 840/1437), is one of the prominent jurists among the ahl l-taqrīr. The majority of Zaydi fuqahā’ belong to the muẕākirūn class. These are the lowest class of the ahl-al-naẓar. As an important result reached in the study, it is possible to express the following: There is a difference between some of the knowledge and opinions in modern Zaydī studies, which include the same subject as Shaharī's work, in terms of the classification of Zaydī fuqahā’ and the terms used. Therefore, the findings and conclusions based on this work should be confirmed by new studies on other Zaydī classics, and existing opinions on Zaydī jurisprudence should be reviewed. (shrink)

Population-based genomics studies have proven successful in identifying genetic variants associated with diseases. High-quality biospecimens linked with informative health data from diverse segments of the population have made such research possible. However, the success of biobank research depends on the willingness of the public to participate in this type of research. We aimed to explore the factors associated with the willingness of the public to participate in biobank research from four low- and middle-income countries in the Arab region (Egypt, Jordan, (...) Morocco, and Sudan). We used a previously validated questionnaire to assess several constructs that included the public’s perceptions, attitudes, and willingness to participate in biobank research. We recruited 967 participants. More than half did not have prior awareness of biobanks. Participants’ willingness to donate biospecimens and health data was less than 10%. Our results also showed that participants harbored concerns with trust, privacy, and with data-sharing involving international researchers. Predictors of willingness to participate in biobank research included no previous involvement in research and positive attitudes toward biobanks. Finally, our study showed several differences between the four countries regarding several of the investigated constructs. We conclude there should be additional efforts to raise public awareness and enhance perceptions of the public in biobanking research to enhance trust. We further recommend qualitative research to explore the underlying factors that contribute to the public’s concerns with international data sharing that would enhance global health. (shrink)

Members of research ethics committees (RECs) face a number of ethical challenges when reviewing genomic research. These include issues regarding the content and type of consent, the return of individual research results, mechanisms of sharing specimens and health data, and appropriate community engagement efforts. This article presents the findings from a survey that sought to investigate the opinions and attitudes of REC members from four Arab countries in the Middle East and North Africa (Egypt, Morocco, Sudan, and Jordan) toward these (...) ethical issues. Our findings suggest that efforts are required to better familiarize REC members with the requirements for ethical biobank research. Additionally, we recommend that further research is undertaken with REC members regarding the main items that should be present in the Material Transfer Agreements /Data Transfer Agreements in their corresponding countries and the type of consent that should be used in genomic research. The current research aims at improving the skills of producing digital stories using the tools of generative artificial intelligence Chat GPT and Google Bard, which are necessary for female student teachers’ specialization: Kindergarten. The current research has used the descriptive approach and the experimental approach with a quasi-experimental design through a design based on one group and comparing the differences between the pre and post-evaluation. The study sample was randomly selected from female students teachers specializing in kindergarten, and their number (...) reached (25) students. A list of producing digital stories standards was prepared and controlled, and a graded performance rating scale was prepared to evaluate the skills of producing digital stories among female student teachers specializing in kindergarten. BackgroundOrgan donation has become one of the most effective ways to save lives and improve the quality of life for patients with end-stage organ failure. No previous studies have investigated the preferences for the different consenting options for organ donation in Egypt. This study aims to assess Egyptians’ preferences regarding consenting options for posthumous organ donation, and measure their awareness and acceptance of the Egyptian law articles regulating organ donation.MethodsA cross sectional study was conducted among 2743 participants over two years. Each participant was required to rank eleven consenting options from 1 to 11, and to report his awareness and acceptance of the seven articles of the Egyptian law of organ donation.Results47% of the participants expressed willingness to donate their organs after death. This percentage increased to 78% when consenting options were explained to participants. “Informed consent by donor only” was the most preferred type of consent for one third of respondents. Awareness of the law articles regulating organ donation was relatively low ranging from 56% to 23%.ConclusionCurrently, around half of the Egyptian population agree to posthumous organ donation. This percentage could be increased significantly by raising the awareness about how the process of donation could be regulated and how the patient’s right of decision could be protected. (shrink)

Cet article examine la théorie de la connaissance immédiate d' ʿAbd al-Jabbār à partir de sonMughnī, ainsi que de textes écrits par ses élèves ou par (...) des Muʿtazilites tardifs. Est aussi étudié le rapport entre cette théorie et les arguments théologiques d'ʿAbd al-Jabbār. Ce travail est divisé en deux parties: en premier lieu, j'étudie la définition de la connaissance immédiate par ʿAbd al-Jabbār et les réactions de ses successeurs; en second lieu, j'analyse sa conception des types de connaissance immédiate étroitement liés à ses arguments théologiques. Despite shared teachings on the heart and continuous prayer, the traditions diverge in practices, such as the Jesus Prayer in (...) Hesychasm and the invocation of Allah's name in Sufism, contributing to the rich tapestry of spiritual experiences. This comparative exploration offers nuanced insights into diverse ways spiritual seekers engage with the divine across cultures. Recognizing universal quests for connection with the transcendent, the analysis contributes to the broader dialogue on mysticism and spirituality. The discussions on divine light, knowledge of God, and transformative processes underscore shared themes, while differences in theological nuances highlight the unique paths individuals traverse in their spiritual journeys. Ultimately, both Hesychasm and Sufism emphasize the experiential dimension of spirituality, fostering profound encounters with the divine despite their theological and philosophical distinctions. Studies on the contributions made to the Arabic language and literature during the Ottoman period generally focused on the Arabic language grammar and rhetoric education given by the Ottomans in the madrasahs. However, it is seen that Ottoman scholars also produced some works in the field of Arabic poetry. In the mentioned period, the studies in the field of Arabic poetry and literature have been increasing in recent years. In this study, a poet, a recitation scholar and an Ottoman Pasha, (...) Köprülü Abdullah Pasha, who was a member of the Köprülü family, who made his mark on the Ottoman administration and served both the science and the state, and who wrote an Arabic divan, and the content of his poetry divan were examined. The poet's divan is in manuscript form in various libraries. There is no study on Abdullah Pasha's poetry and his manuscript. Due to Abdullah Pasha's family, he received a good education, served in the geographies where the Arabs lived, especially when he was the governor in Egypt, he benefited from the al-Azhar scholars and wrote poems about the subjects discussed in classical Arabic literature. It is thought that such studies will also contribute to the studies against the claims that Arabic collapsed during the Ottoman period. (shrink)

The city of Samarra is one of the major cities of Iraq that Yaqout al-Hamwi described in the dictionary of countries by saying (it became the greatest country of God) and Al-Qazwini told about it in the monuments of the country (a great city located on the outskirts of the east of the Tigris between Baghdad and Tikrit) built by the Abbasid Caliph Al -Mu'tasim in God in 221 AH/ 835 M, and it is originally a monastery for the Christians, (...) who bought it for 5,000 dinars, and took it as a capital for its succession, and reached its prosperity and its glory is the days of the caliph Al -Mutawakkil, 247 AH / 861 AD / 892. However, after 58 years, it was left as the capital of the Abbasids when the Abbasid Caliph, Al-Mutamid Allah, abandoned it in the year 279 AH / 892 AD, and took Baghdad, the old capital, as his headquarters, which maintained its position as the capital of the Arab Islamic state until the fall of the Abbasid Caliphate at the hands of the Mongols in the year 656 AH / 1258 AD.Al-Mu'tasim and the caliphs and princes who came after him built palaces, houses, mosques, and other things in Samarra. Samarra was famous for its Great Mosque, distinguished by its high, twisted minaret. It also contained the shrine of the two imams, Ali al-Hadi 254 AH/868 AD and Hasan al-Askari 260 AH/873 AD. This research aims to study the description, life and biography of the Ayyubid sultan Saladin by Ibn Jubayr, and the economic and social conditions of Egypt as witnessed and described by the traveler Ibn Jubayr and the following results are concluded: First: Ibn Jubayr praised the Ayyubid sultan Saladin and his good conduct and behavior with the subjects, his fairness, his patience and forbearance, modesty and his keen in interest in Jihad for the Sake of Allah. He called him the (...) (Just Sultan).Second: Ibn Jubayr talked about the keen interest of the sultan in the economic matters of the subjects and especially in regard to tax reform in the state where he dropped them completely, and worked to promote security and order, and securing the trade routes, and also gave an accurate description of the international trade stations in Egypt between the east and the west and the markets in some of the cities.Third: Ibn Jubayr described the keen interest of the Sultan in regard to the religious and scientific institutions in the society like schools, mosques, religious landmarks and hospitals through the establishment of some of those institutions, and creating the endowments connected to each one of them, in addition to securing steady salaries for those working and serving in those institutions, and spending on the scholars, students and the poor who came to those institutions. : The schools of fiqh applied different methods to eliminate contradictions between narrations. In fact, this difference in methodology directly led to fiqh disagreement. Thus, a school explains within the framework of its own procedural system which of the contradictory narratives it uses as evidence, the reason for using this narrative, how they interpret other narrations about the subject or the reason for not using these reports as evidence. This article aims to chronologically examine the theory that the Ḥanafī developed (...) about antithetical narratives based on ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī, al-Pazdawī and al-Sarakhsī. Moreover, the criticisms and contributions made by the scholars of the principles of jurisprudence are determined. Frequently repeated approach in some research that the Hanafis first used the abrogation to fulfill the contradiction between the narrations is questioned within the framework of the aforementioned scholars’ viewpoints Summary: The theory of contradictory narratives, developed as part of the narration theory, has an important position in the sense of the school’s approach to the Sunnah. This is because the system that a school of jurisprudence implements to fulfill the contradiction between narrations has an important influence in scholars’ juridical opinion. In some studies carried out today, the system developed by the Ḥanafī to eliminate the contradiction between narratives is presented in two different ways as abrogation, preference, conciliation and not to use as evidence or abrogation, conciliation and applying principles. The common point of the two hierarchies of solution is placing abrogation in first rank. In order to test the accuracy of this information in this research, we studied the system that the Ḥanafi scholars who lived in the first five centuries of the Hijra followed to eliminate the contradiction between the narrations. The development of this theory in the five centuries of the Hijra was examined on the basis of the views of ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī and al-Sarakhsī. It is an indisputable fact that the construction and development of a theory requires a process. In this context, the present study investigated when and on which principles the theory of contradictory narratives on Ḥanafīan theory of narrative/Sunnah is started to be instituted; who and for what reasons contributed to it during this evolution process and how; and how it is instituted the way of solution hierarchy in theearly period which makes a differentiation in comments between Ḥanafīan later. This theory was enriched by principles that were developed with different perspectives during a long process and its comprehensibility was boosted using new concepts and systematic expression. Ḥanafī legal theorists benefited from the opinions of masters of the jurisprudence school to enrich this theory in terms of principles. This suggests that the theory is a scientific effort aimed at discovering how masters of the jurisprudence school are following a method in the face of contradictory narratives. As far as known, Isā ibn Abān is the first theoretician to have detailed methodological explanations related to contradictory narratives between the Hanafi scholars. This shows that the theory related to contradictory narratives was established at the beginning of the third century of the hegira. 'Isā ibn Abān divides the opposite narratives into hadiths that are compatible with consensus and hadiths that are contrary to consensus on the basis of consensus. He accepts the hadith in the first group and he evaluates the hadith in the second group as the abrogated if it is authentic. It must be stated that this solution path which Isā ibn Abān put forth is of high practical value. There is no practical value in fıqh to eliminate the contradiction between the hadith which is compatible with the consensus and the hadith contrary to this consensus by the conciliation method. Moreover, giving an active role to the consensus in the determination of the abrogating and abrogated also prevents easy access to the method of abrogation. ‘Isā ibn Abān divides hadiths that are without consensus about their provisions into two: the appearance date is known and unknown. He first applied the conciliation method to fulfill the contradictions between the narrations in both groups. If the problem is not solved by the conciliation method, Isā applies the abrogation method for narrations whose the appearance date is known. The ones that the date is not known can be acceptable in accordance with the originals, and if this is not possible, he says that both narrations cannot be used as evidence. al-Jaṣṣāṣ, who is one of the people who convey mostly al-Karkhī's views on fiqh methodology, does not convey the views of al-Karkhī on contradictory narratives in integrity that we see in the transmission of 'Isā ibn Abān’s theory and its interpretation. It is understood that al-Jaṣṣāṣ benefited from the views of al-Karkhī to improve the system of Isā ibn Abān. This suggests that al-Karkhī basically accepted the system of contradictory narratives established by Isā ibn Abān. al-Jaṣṣāṣ 's most important role in the theory of contradictory narratives is based on the principles laid down by ‘Isā ibn Abān and al-Karkhī. The person who mostly contributed to this theory after al-Karkhī is al-Dabūsī. It is understood from al-Dabūsī’s accounts that he divides the contradiction into two parts, the truth and the apparent. al-Dabūsī stipulated for evaluating a contradiction as a real contradiction. These conditions are, in essence, solutions for the elimination of the contradiction. When it comes to al-Sarakhsī, he dealt with this issue more precisely with concepts such as “evidence”, “judgement”, “state”, “date is clear in the text”, “date is not clear in the text”. In the system of al-Sarakhsī, the last option is the abrogation to eliminate the contradiction. (shrink)

This article deals with the subject and semantic analysis of human organs mentioned in the Holy Qur’ān. After the relevant verses were researched and identified in accordance with thematic commentary methodology, their scientific and semantic analysis was carried out objectively. The comments of commentators in this context were also examined in the study. After the verses in which the organs are found are researched, their definitions, then an objective and brief interpretation are made, and the semantic usage of each is (...) shown. The subject consists of the organs in the head, the organs in the trunk, the organs in the body and limbs. As is known, human organs are attributed to Allah in the Qur’ān. While the predecessor avoided interpreting the organs attributed to Allah as they are, their successors interpreted them in accordance with the glory of Allah, based on the use of the Arabic language. However, some contemporary scholars say that such verses are representative narratives. In reality, there is nothing like Allah. However, God explains Himself with people's organs and actions so that they can understand His truth. These verses aim to explain the unknown world and its metaphors by comparing them to known events and phenomena in the world, and in this way to bring religious truths closer to the human mind. In the Qur’ān, expressions such as sealing or veiling the senses, as in the verse "Allah has sealed their hearts and ears, and there is a veil over their eyes, and there is a great torment for them" (al-Baqarah 2/7), also indicate the senses' deprivation of true perception expresses. The Holy Qur’ān takes care to mention the organs in the human body and uses them in many senses, both literal and figurative, in man's relationships in this world and the afterlife. He gives him examples of organs so that he can take lessons and advice, and reminds him of his beautiful creation and the blessings he gives because of these organs. The semantic uses of body organs in the Holy Qur’ān vary, as they contain literal connotations of the physiological meaning of the organ. This is a condition characterized by most of the organs mentioned once in the Holy Qur’ān. However, the connotations of the organs mentioned many times have varied and gone beyond their literal meanings, they have been used in figurative meanings and contain secondary connotations. It included many topics related to the existence, role and performance of humans in world life. For example, the hand is used for power, giving, blessing, dominance and specialization. Linguists did not distinguish between similar organs such as body, object and body, but on the contrary, they compared them to each other to the point of creating confusion. However, while interpreting them, many commentators have tried to separate them according to the context of the verse and take into account the differences in meaning between them. The organs are mentioned in general terms in the Holy Qur’ān, but the details they contain are not touched upon. For example: It talks about the head, but does not touch the hair, eyelashes and brain. It is talking about bones and does not touch parts such as the skull, ribcage, pelvis, and thighs. It mentions the abdomen but does not mention its parts such as the belly button, esophagus, stomach, liver, kidney, bile and bladder. In addition, in the Holy Quran, there are organ names in the human body that are used metaphorically in different meanings rather than expressing the reality of the organs. Esophagus (المريء) is one such expression. This expression is used in the sense of blessing for eating and drinking. For example, it is used in this sense in the verse, "Give women their dowry as a matter of right (with good will), and if they voluntarily donate some of that dowry to you, enjoy it with pleasure" (an-Nisa: 4/4). For example, Liver (الكبد) in the verse "We created man among difficulties" (el-Beled: 9/4), it expresses difficulties and constant troubles. The study deals with the sixty-two organs mentioned in the Holy Qur’ān and includes all the organs in the internal and external parts of the body mentioned in six hundred and forty-five verses. These are six hundred organs in total in the Qur’ān, in accordance with the statistics we made during our research. It is used ninety-one times. (shrink)

However, in today’s Islamic countries, it is well known that some testators deprive the inheritors of inheritance fully or partially through various ways such as donation, last will, and fictitious. Last will, as a legal term, means that a person transfers his\her property complimentarily to person\persons who have the right to (...) inherit originally or legally, provided that it is valid after death. In Islamic law, principally, making a last will to foreigners is regarded as a legitimate act. However, today, as it was in the past, the right of last will is being misused in causing harm to the inheritors and depriving them of the inheritance. For this reason, in Islamic law, there have been taken some precautions to prevent any possible misuse of the last will right in order to protect the rights of the inheritors and third persons. These precautions are as follow: The last will that is made is restricted to one third of the total amount; It is prohibited to make last will to the inheritors; There have been laid down some formal conditions for proving a last will; It is prohibited to make a last will with the intention of harming the inheritors, even if it is one third and less than one third. All legal systems that accept the legitimacy of the last will set out some regulations and restrictions on the use of the last will to protect the rights of individuals and public order. In Islamic law, the last will is also regarded as a legitimate regulation in order to meet people's earthly needs and to be a means of solidarity and getting reward in hereafter. However, in today's Islamic countries, the right of last will is being misused in causing harm to the inheritors and depriving them of the inheritance. In Islamic law, the precautions that have been taken to prevent any possible misuse of the last will right in order to protect the rights of the inheritors and third persons are as follow: The last will that is made is restricted to one third of the total amount The Prophet Muhammad visited Sa'd b. Abu Vakkas due to his illness in the year in which the Last Pilgrimage was being performed. Sa'd b. Abu Vakkas had no children other than a daughter. That is why he told the Prophet that he wanted to make a last will according to which the two third of his property shall be given to the foreigners. Thereupon, the Prophet Muhammad told him that he could only give one third of his property maximum. The Prophet Muhammad explained the reason why as follows: “It is better to leave your inheritors as wealthy than to leave them as needy people.” ; Muwatta, “Wasiyyāt”, 3; Tirmīzī, “Wasāyā”, 1, Abū Dāvūd, “Wasāyā”, 2; Nasāī, “Wasāyā”, 3; Bayhakī, “Wasāyā”, 5.). The Muslim jurists who regard this event as a proof have arrived at the consensus that the Muslims can only give one third of their property to foreigners by means of the last willIt is prohibited to make last will to the inheritors The Prophet Muhammad said, "Allah surely gives every right. There is no will to inheritors.” The Muslim jurists who regard this saying as a proof have arrived at the consensus that the last will to inheritors cannot not be made. There have been laid down some formal conditions for proving a last will Since a last will is a process that is upon death, there might be some disagreement between the inheritors and those who are a last will made to after the death of testator. For this reason, the last will shall be proven so that any possible dispute would be prevented. In the classical Islamic Law, it is emphasized that the last will should be oral, written or by any means of signs that might express oneself well, and the last will shall be made in the presence of the witnesses as a matter of principle. However, in my opinion, following the verses that require the last will to be made before the witnesses, placing the last will on record through an official procedure is much more suitable in regard to the purpose of the Shari’ and the spirit of Islam. Indeed, in the Islamic countries, the Family Law Codes are subject to the legal dispute that a case cannot be open if a last will is not been made in accordance with the law. It is prohibited to make a last will with the intention of harming the inheritors, even if it is one third and less than one third. In Islamic law, the last will made to foreigners is limited to one third of the property of the testator. Nevertheless, still there is a possibility of misusing this right against the inheritors with the intention of depriving them of the inheritance even if it is one third and less than one third. However, the verse which lay down the condition "the will made without harming the inheritors" indicates that the last will is legitimate only with the intention of not harming the inheritors, even if it is less than one third. Therefore, the last will made to foreigners with the intention of harming the inheritors, as it is contrary to the purpose of the law maker, can be restricted by the public authority. No doubt, the most important of the above-mentioned precautions is to restrict a testator's right of the last will to one third of the property when it is a foreigner to whom he is willing to give from his property, and the remaining two third is left to the inheritors. That is why in Islamic law, this two-third share, which is legally guaranteed and will be passed on to the inheritors, is called "reserved share". In principle, except for some exceptions, the testator has no authority to give from the "reserved share." Although in Islamic law, theoretically, the two-third share called "reserved share" is legally secured, nowadays, the testators are misusing their right of the last will. Therefore, the question “is it possible for the public authority, in Islamic law, to restrict a person’s essentially legitimate right of making last will in a case of misuse?” is quite important concerning our subject matter. It has been accepted as a basic principle that the acts in the category of "mubah" in Islamic law are to be taken without violating the rights of others and harming the public. Accordingly, it is possible for the public authority to restrict the acts that are taken in contradiction to the purpose of Shari and the interest of others. From this point of view, the use of the right of the last will in Islamic law is not absolute and unrestricted. Therefore, in the case of harming to the inheritors, it is possible that the right to be restricted by the public authority. As a result, the last will right, in Islamic law, is restricted in four different ways in favour of the inheritors as briefly summarized above. (shrink)

Bu durum, rüya ve şeriatlerin farklılığıyla ispat edilmeye, bu fikre temayül gösteren ancak Kur’ân hakkında olumsuz bir argüman olarak kullanan Montgomery Watt gibi müsteşriklere de cevap verilmeye çalışılmıştır. Bu yapılırken ilk önce bilinçaltının anlaşılması hususunda bazı örnekler verilmiş sonra rüya sembollerinde baskın olan kültürel unsurlara temas edilmiştir. Rüyalardaki sembollerin şekillenmesinde mantıksal bağı irdeleyen İslam ulemasının açıklamalarına ve rüya tevillerine de yer verilmiştir. Bu (...) yorum ve tevillerden anlaşıldığı kadarıyla insanlarda ortak görülen sembollerin Jung’un arketip, İslam ulemasının ise zihinsel kalıp ve manaların elbisesi dediği bir nevi kültürün kodlarından oluşan bilinçaltı alfabesi tarafından formlaştığı anlaşılmaktadır. Dini değer ve ifadeler Müslüman kültürde en dominant öğeler olduğundan Müslüman yorumcular genelde rüya sembollerini Kur’an ve hadisteki sözler veya bu sembolleri çağrıştıran ifadelerle yorumlamaya çalışmışlardır. Bu mantıktan hareketle tefsirde büyük problem olarak görülen Hz. İbrahim’in, oğlu İsmail’i kurban etme olayı ele alınmış ve nasıl anlaşılmasının gerektiği üzerinde durulmuştur. Bunun, baskın kültür altında sembolleşen bir rüya olduğu ve İsrail Oğullarına ‘Bakar’ kesme emriyle toplumun yanlış algısının değiştirilmesinin amaçlanması gibi çocukların tanrılara kurban edildiği ortamdaki yanlışlığın giderilmesi, kurban ritüelini tebdil edilmesinin amaçlandığı ifade edilmiştir. Daha sonra şeriat-ontolojik gerçeklik ilişkisi irdelenmiş, dinde bütün insanların ortak fıtratının esas alındığı ve bundan dolayı dinin bütün insanlar için değişmeyen bir olgu, şeriatlerin ise kültürün baskın olduğu ve dolayısıyla bir yönüyle ilişki içinde olduğu toplumsal bilinçaltı olduğu vurgulanmıştır. Kur’ân’da, dinin temel prensipleri ve resullerin üzerine birleştikleri kapsamlı şeriat kanunları dile getirilmiştir. Genel hatlarıyla din, Allah’ın varlıkları üzerine yarattığı (insanın tabiatının kolektif değişmezliğine dayalı) ve bütün mahlûkata sevimli geleni, marufu emretmeyi, münkerden nehyi, temiz şeyleri helal eden, zararlı olan şeyleri haramı eden emirleri içermektedir. İslam ulemasına göre bütün semavi dinlerde esas olan Allah’a, meleklerine, resullerine, kitaplarına ve ahiret gününe iman etmek, insanın yaptığı takdirde Müslüman olacağı fiilleri işlemektir. Bu iman da doğal olarak dünyadan yüz çevirmeyi, ahirete yönelmeyi, güzel ahlakı edinmeyi ve kötü ahlaktan da kaçınmayı gerektirir. Ancak şeriatlar ise birbirinden farklılık gösterebilir. Çünkü şeriatlar dinin indiği toplumun hallerini ve maslahatlarını esas aldığından değişiklik arz eder. Şeriatların farklılaşmasında toplumsal bilinçaltının göz ardı edilmediğini göstermek bağlamında Kur’ân’dan örnekler verilmek suretiyle savunulan tez ispat edilmeye çalışılmıştır. Bunlardan birisi, Kur’ân’da Arapların ortak duygularının esas alınması, kültürel bazı unsurların kullanılması, bir diğeri de yabancı isimlerin Arapların ifade ettiği şekliyle, ümmi anlayışa uygun kullanılmasıdır. Ayrıca bu konuda bazı helal yiyeceklerin Yahudilere haram kılınması ve diğer şeriatlerde yer alan bazı farklılıklar üzerinde durulmuştur. Helal yiyeceklerin haram kılınması konusunda Hz. Yakub’un yakalandığı ağır hastalıktan iyileştiği takdirde sevdiği yiyecekleri yememeyi nezretmesi, buna bağlı olarak iyileşince deve eti ve sütünü yiyip içmemesi, daha sonra çocukları ve ümmetinin de bu yiyeceklerden uzak durması sonucunda Tevrat’ta bunların haram kılınması örneği üzerinde durulmuştur. Bu örnek, şeriatlerin farklılaşmasının nedeninin bir şeye karşı tavrın toplumsal bir alışkanlık halini almasının sonucu olduğu ifade edilmiştir. Nitekim teravih namazının Müslümanlarca toplu kılınması ve buna devam edilmesi durumunda farz kılınır endişesiyle evlerinde kılmalarını tavsiye eden Allah Resulünün endişesinin de bunu pekiştirdiği dile getirilmiştir. Diğer şeriatlerde bazı farklılıklar konusunda ise orucun öncekilere farz kılınmasına rağmen keyfiyetinin farklı olması üzerinde durulmuştur. Aynı şekilde namaz, zekât ve haccın semavî dinlerinin hepsinde olmasına rağmen keyfiyetinin değiştiği örneklerle izah edilmiştir. Bu doğrultuda milletlerin yaşam tarzlarının ve kültürünün dolayısıyla toplumsal bilinçaltı şeriatlerin farklılığında gözönüne alındığı ifade edilmiştir. Nitekim İsâ peygambere tabi olanların kendilerine emredilmemekle birlikte Allah’ın rızasını elde etmek için ruhbanlığı kendilerine farz kılmaları ve buna devam etmeleri karşısında Allah’ın buna itibar ederek, ruhbanlıkta bulunanlara ücretlerini verdiğini ifade etmesi de bu durumu pekiştirmektedir. Sonuç olarak din ve dine taalluk eden her şeyin insanlığın ortak fıtratını esas aldığını, şeriatten şeriate değişiklik gösteren unsurların da kültürel ve bir yönüyle toplumsal bilinçaltıyla ilgili olan hususlar olduğu ortaya konulmaya çalışılmıştır. Basic characteristic of Islamic heritage law, principally it has accepted the two-to-one ratio between the male and the female children/siblings in division of heritage. In Islamic inheritance law, the main/basic reason why the share of the male is twice the share of the female is no “value” judgments given to female/women in creation and gender in Islam, on the contrary, are real realities related with the roles and financial obligations that man and woman have undertaken, in other words, related with (...) “socio-economic structure/fact” in the family and society structure foreseen by Islam. As a matter of fact, “need principle” is based on in division and succession of heritageand a fair arrangement has been made in accordance with the rights and responsibilities of the husband and wife in Islamic Law. In some classical tafsīr books, the concept of “degree” in the verse “... Men have a degree (right) over women” (Al-Baqara 2/228) mentioning the mutual rights and responsibilities of women and men; and the expression of “lil al-dhakari mithlu haẓẓ al-unthayain” in the verse –the inheritance of man is the share of two women– (Al-Nisā 4/11) mentioning the inheritance shares of boys and girls is interpreted against the woman by disregarding the intended purpose and socio-economic contexts of these verses. As a result of this interpretation, the share of men in inheritance is twice the share of women in Islamic law is ontologically (existential/creation) based on a justification that “man is superior to woman”. In this article/study, an analyticallook atthe interpretations in some classical tafsīr books on the axis of “daraja/degree” and “lil al-dhakari mithlu haẓẓ al-unthayain” that today sheds light on the sociological-historical background of depriving the daughter from the heritage will be made. Summary: Just as there is no way to determine a person’s sex, it is not either possible by reason to have such an opportunity. - With the possibility of medical intervention nowadays - sex is determined by the discretion of the Supreme Creator rather than will. Indeed, it is mentioned in the Qur’ān: To Allah belongs the dominion of the heavens and the earth; He creates what he wills. He gives to whom He wills female [children], and He gives to whom He wills males (Al-Shūrā 42/49.)In addition to human biological sex, there is also social gender. Indeed, the term “sex” refers to being biologically female or male, while the term "gender" refers to the social and cultural identity of a woman or man, or the social roles that occur in the historical process.Accordingly, while it is not possible to determine biological sex (in normal circumstances in advance), determining gender is shaped by the cultural will of individuals and societies. As a matter of fact, gender is shaped according to the religions, customs and cultures of the societies and it shows differences according to time, culture and family structure. In this context, in the pre-Islamic Arab society, the gender of the girl or the woman was shaped by the custom of the ritual and customs. Indeed, it is a known fact that during the period of Jahiliyyah, in terms of social gender, the girl/woman has been deprived of many social and economic rights, especially heritage. The Qur’ān has brought the girls who, in the period of Jahiliyyah, were oppressed in terms of gender, deprived of many social and economical rights, treated as second class human, embarrassed of themselves and buried alive, to the same position as man. In this context, as it is in every field in the direction of social structure and social conditions of that day, also in the field of inheritance law, a number of regulations were made in the Qur’ān and the Sunnah being the main sources of Islam. The divisions of the inheritance were connected with religious and legal rules and the shares of the inheritance of the sons and daughters were determined by naṣṣ (verses and hadiths).However, in Islamic inheritance law, as a requirement of the structure of family and society accepted by Islam, in principle, “two-to-one” measures have been adopted between male and female children. As a matter of fact, in this aspect, it is mentioned in the Qur’ān: Allah instructs you concerning your children: for the male, what is equal to the share of two females (Al-Nisā 4/11.)On one hand, the principle that Islamic law brings between boys and girls; Seems to be an inequality in terms of the arrangement in which "the inheritance share of the male child is twice the share of the female child", while on the other hand, within the border of in the family foreseen by Islam, this regulation has not been seen as an injustice and inequity by Muslim societies, because in Islamic family law, a man is obliged to ensure the livelihood of the family after marriage. He is also obliged to give his wife her mahr when marrying.In Islamic inheritance law, “necessity principle” is taken as the basis of responsibility that women and man have undertaken in family and society. Therefore, even though giving nothing at all to those who are not in need and giving less to those who are in less need, giving too much to those who are in much need might seem contrary to the principle of equality, it is a necessity of the principle of justice and fairness. As a matter of fact, while "law equality, necessity in sharing" principle, law is arranged according to people's qualifications, goods and wealth sharing is divided according to the needs of people. In this context, there has been a fair division in Islamic heritage law based on the necessity, (distributive) justice and fairness principle. Indeed, the French philosopher Roger Garaudy (1913-2012), who chose /converted to Islam, evaluates the following about the proportion of male child in the Qur'an to that of female child: “When we consider that in the Arab society all the obligations of the family and of the care of the parents and of all the things that we call ‘social security’ today are put on the shoulders of the husband, the hereditary male child's share must be twice as high as the female child’s is”.As Garaudy argues, the difference in the inheritance of women and men in Islamic inheritance law is not a legal discrimination/inequality, but a form of divisiveness stemming from a need based on the role and responsibility that women and men have undertaken in the family and society. Therefore, giving nothing to those who need nothing, giving little to those who need little, and giving a lot to those who need a lot,even though may seem contradictious to the principle of equality, it becomes a necessity of equity and (distributive) justice principle. In this case, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child, is social and economic reasons and it is possible to rank them as follows:1) According to Islamic law, women are not obliged to make their own economic livelihoods. The woman’s economic responsibility belongs to her father or brothers before marriage, and then to her husband after marriage. 2) When a woman is married she is not responsible for herself or other family members’ livelihood. The male is obliged to make a living for himself, his wife and his children.3) While married, the male is obliged to give the wife mahr. The woman has no such responsibility.As it is understood from the above explanations, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child is not about the ontologically “value” based on creation and sex given to the woman (girl child) in Islam. On the contrary, it is the real facts concerning the family and society structure that Islam predicts, the roles and financial obligations that man and woman have undertaken, namely “socio-economic structure/fact”.In some commentaries in classical commentary books, the rights and responsibilities of women and men are referred to, like: the word “degree” mentioned in: …but the men have a degree over them [in responsibility and authority (Al-Baqara 2/228), and the talk about the inheritance shares of boys and girls in: for the male, what is equal to the share of two females (Al-Nisā 4/11). Eventually, the concepts “lil al-dhakari mithlu haẓẓ al-unthayain” have been associated with the gender of the woman/girl child ontologically (based on social fact) by ignoring the referent purpose and socio-economic contexts of these verses. As a result of these interpretations, it was desired that the Islamic law principle of inheritance share of male child being twice the share of female child, ontologically, should be based on a justification that “man is superior to woman”.In this study, some of the era’s dominant culture classical interpretations grounding women's inheritances share on her gender and based on the axis of the concepts of "degree" and “lil al-dhakari mithlu haẓẓ al-unthayain” in the related verses of the Qur'ān will be elaborated. İslamiyet’in Türkler tarafından kabul edilmesiyle birlikte Türk edebiyatında, İslamiyet’i konu alan eserler telif edilmiştir. Bu eserlerin bilhassa tevhid, naat, münâcât ve hâtime bölümlerinde Allah’ın rahmetine ve Hz. Muhammed’in şefaatine nail olmak arzusunun dile getirilmesi bir gelenek hâline gelmiştir. Zamanla, şefaati konu edinen ve başta Hz. Muhammed olmak üzere Allah’ın şefaat etmesine müsaade buyurduğu kişilerden şefaat isteğinde bulunulan manzum ve mensur müstakil eserler telif edilmiştir. Bu eserler, dinî-tasavvufi türlerden ayrılarak şefaatnâme olarak adlandırılmıştır. Şefaatnâmelerin geneli, eski Anadolu Türkçesi döneminde telif edilen Hikâye-i (...) Kesikbaş, Hikâye-i Deve, Hikâye-i Güvercin, Hikâye-i Geyik, Hikâye-i Kız, Hikâye-i İsa, Hikâye-i İsmail ve Hikâye-i İbrahim gibi dinî manzum hikâyelere anlatım ve üslup özellikleri bakımından benzemektedir. İslam dinini halka öğretmek amacıyla sade bir Türkçe ile kaleme alınan ve tahkiyenin ön planda olduğu bu hikâyelerden biri, muhtevasından dolayı şefaatnâme türü içerisinde değerlendirdiğimiz Şefaatnâme-i Yahyâ’dır. Çalışmamıza konu edilen bu eser, Süleymaniye Kütüphanesi Yazma Bağışlar Bölümü’nde 4042 demirbaş numarasıyla kayıtlı olan ve içerisinde Süleyman Çelebi’nin (ö. 1422?) Vesîletü’n-Necât’ı ile eski Anadolu Türkçesi döneminde telif edilen dinî muhtevalı pek çok manzum hikâyenin bulunduğu yazmanın 155a-160a sayfaları arasında yer almaktadır. Şefaatnâme-i Yahyâ, aruzun “fâ‘ilâtün / fâ‘ilâtün/ fâ‘ilün” kalıbıyla ve mesnevi nazım şeklinde yazılmıştır. 154 beyitten müteşekkil bu eserde, Hz. Muhammed’in günahkâr ümmet için üzülüp ağlaması, o esnada sohbetinde bulunan Hz. Ebû Bekir, Hz. Ömer, Hz. Osman, Hz. Ali, Hz. Ayşe ve Hz. Fatma’ya günahkâr kullara şefaat için ne yapacaklarını sorması ve onların da bu soruyu cevaplamaları tahkiye edilmiştir. Bu makalede, öncelikle şefaatnâme hakkında bilgi verilmiştir. Ardından, Şefaatnâme-i Yahyâ’nın dil, şekil, anlatım ve muhteva özellikleri incelenmiştir. Sonrasında ise Yahyâ’nın Şefaatnâme’sinde ele alınan konunun Ömeroğlu’nun (ö. 14. yy) Şefaatnâme’sinde, Pir Muhammed’in (ö.?) Şefaatnâme’sinde, Topkapı Sarayı Müzesi Kütüphanesi Y. Y. 520/2 numarada kayıtlı yazmanın 30a-34a yaprakları arasında bulunan müellifi meçhul bir şefaatnâmede de yer alması sebebiyle bu dört metin mukayese edilmiştir. Farklı şairlerin kaleminde, aynı olay örgüsünün nasıl ifade edildiği bir tablo dâhilinde ortaya konmaya çalışılmıştır. Makalenin sonunda, Şefaatnâme-i Yahyâ’nın transkripsiyonlu metni hazırlanarak araştırmacıların istifadesine sunulmuştur. (shrink)

The study aims at shedding light on plagues and epidemics that hit Egypt during the Mameluke period through describing the plague disease and the plagues and epidemics that hit Egypt and the social and economic impact on the Egyptian society. The study is based on some historical sources that are contemporary of the Mameluke period, especially the book "Al-Suluk li-marifatiduwal Al-muluk" by Al- Maqrizi and we reach the following conclusions through this research:- Plagues are bacterial and lethal epidemics that spread (...) fast, and have the symptoms of high temperature nausea, and severe fatigue. Most plagues that hit Egypt during the Mameluke era were very severe, and that what is usually referred to as the Great plague or Black Death, where the patient dies within one week of having the disease.- The plagues had harsh social effects on the population, where it caused the death of individuals, and damaged hundreds of Egyptian villages and cities, The conditions of the society almost came a halt, and were an impetus for the people to bind in social solidarity, and the true repentance to Allah the almighty, and the increase of worship and alms hoping that Allah the almighty will shield the people from this disease. - The plagues and epidemics led to disorder and disruption of the economic conditions of the society, where most land was left without farming and most trades and crafts were disrupted and earnings hit lows in the markets and trade was in recession in commerce and trade in general.
